Calif. man behind anti-Muslim film ordered jailed

LOS ANGELES (AP) ? The mystery surrounding the man behind the crudely produced anti-Islamic video that sparked violence in the Middle East took a strange turn after he appeared in court and gave yet another name in a string of aliases.

Arrested on Thursday after authorities said he violated his probation from a 2010 check fraud conviction, Nakoula Basseley Nakoula told a judge his real name was Mark Basseley Youseff. He said he'd been using that name since 2002, even though he went by Nakoula in his fraud case.

The full story about Nakoula and the video "Innocence of Muslims" still isn't known more than two weeks after violence erupted in Egypt and Libya, where Ambassador Christopher Stevens and three others were killed in Benghazi. Violence related to the film has since spread, killing dozens more.

Citing a lengthy pattern of deception and the potential to flee, U.S. Central District Chief Magistrate Judge Suzanne Segal ordered Nakoula to remain in prison without bond until another judge can hold a hearing to determine if he broke the terms of his probation.

"The court has a lack of trust in this defendant at this time," Segal said.

Prosecutors noted Nakoula had eight probation violations, including lying to his probation officers and using aliases. He could face new charges that carry a maximum two-year prison term.

After his 2010 conviction, Nakoula was sentenced to 21 months in prison and was barred from using computers or the Internet for five years without approval from his probation officer, though prosecutors said none of the violations involved the Internet. He also wasn't supposed to use any name other than his true legal name without the prior written approval of his probation officer.

Three names, however, have been associated with Nakoula this month alone.

The movie was made last year by a man who called himself Sam Bacile. After the violence erupted, a man who identified himself as Bacile spoke to media outlets including The Associated Press, took credit for the film and said it was meant to portray the truth about Muhammad and Islam, which he called a cancer.

The next day, the AP determined there was no Bacile and linked the identity to Nakoula, a former gas station owner with a drug conviction and a history of using aliases. Federal authorities later confirmed there was no Bacile and that Nakoula was behind the movie.

Some of the false statements in Nakoula's alleged probation violations had to do with the film, Assistant U.S. Attorney Robert Dugdale said. Nakoula told probation officials his role was just writing the script, and denied going by the name Sam Bacile in connection with the film, Dugdale said.

Before going into hiding, Nakoula acknowledged to the AP that he was involved with the film, but said he only worked on logistics and management.

Nakoula, a Christian originally from Egypt, then went into hiding after he was identified as the man behind the trailer, which depicts Muhammad as a womanizer, religious fraud and child molester. He met with federal probation officials two weeks ago, led out of his home in suburban Cerritos in the middle of the night, flanked by Los Angeles County sheriff's deputies and cloaked in heavy clothing to protect his identity.

The public got their first good look at Nakoula on Thursday, although the news media was banned from the courtroom and reporters had to watch the proceedings on a TV in a nearby courthouse.

Nakoula wore beige pants and a collared shirt when he was led into the courtroom handcuffed and shackled. He appeared relaxed, smiling at one point before the hearing and conferring with his attorney.

Nakoula's attorney, Steven Seiden, sought to have the hearing closed and his client released on $10,000 bail. He argued Nakoula has checked in with his probation officer frequently and made no attempts to leave Southern California.

Seiden was concerned that Nakoula would be in danger in federal prison because of Muslim inmates, but prosecutors said he likely would be placed in protective custody.

Lawrence Rosenthal, a constitutional and criminal law professor at Chapman University School of Law in Orange, said it was "highly unusual" for a judge to order immediate detention on a probation violation for a nonviolent crime, but if there were questions about Nakoula's identity it was more likely.

"When the prosecution doesn't really know who they're dealing with, it's much easier to talk about flight," Rosenthal said. "I've prosecuted individuals who'd never given a real address. You don't know who you're dealing with, and you're just going to have very limited confidence about their ability to show up in court."

Enraged Muslims have demanded punishment for Nakoula, and a Pakistani cabinet minister has offered a $100,000 bounty to anyone who kills him.

First Amendment advocates have defended Nakoula's right to make the film while condemning its content. And federal officials likely will face criticism from those who say Nakoula's free speech rights were trampled by his arrest on a probation violation.

In arguing that Nakoula is a possible flight risk, Dugdale said Nakoula couldn't even reveal something as fundamental as his real name.

"He's a person who simply can't be trusted," he said.

And in addition to finding prostate cancer early, screening can also find prostate cancers that never would have caused harm in a man?s lifetime. In either case, screening does not bring benefits.

This matters, because screening can lead to unnecessary treatment, which carries important harms. All treatments for prostate cancer have potential side effects, including trouble controlling urine flow, difficulty having sex, infections, and other serious health problems. Many expert groups now recommend against routine prostate cancer screening because, overall, the harms may outweigh the benefits.

But most groups also recognize that screening is an individual decision that is between a man and his doctor. A celestial witch?s broom? A new view of the Pencil Nebula

ScienceDaily (Sep. 12, 2012) ? The Pencil Nebula is pictured in a new image from ESO's La Silla Observatory in Chile. This peculiar cloud of glowing gas is part of a huge ring of wreckage left over after a supernova explosion that took place about 11 000 years ago. This detailed view was produced by the Wide Field Imager on the MPG/ESO 2.2-metre telescope.

Despite the tranquil and apparently unchanging beauty of a starry night, the Universe is far from being a quiet place. Stars are being born and dying in an endless cycle, and sometimes the death of a star can create a vista of unequalled beauty as material is blasted out into space to form strange structures in the sky.

This new image from the Wide Field Imager on the MPG/ESO 2.2-metre telescope at ESO's La Silla Observatory in Chile shows the Pencil Nebula [1] against a rich starry background. This oddly shaped cloud, which is also known as NGC 2736, is a small part of a supernova remnant [2] in the southern constellation of Vela (The Sails). These glowing filaments were created by the violent death of a star that took place about 11 000 years ago. The brightest part resembles a pencil; hence the name, but the whole structure looks rather more like a traditional witch's broom.

The Vela supernova remnant is an expanding shell of gas that originated from the supernova explosion. Initially the shock wave was moving at millions of kilometres per hour, but as it expanded through space it ploughed through the gas between the stars, which has slowed it considerably and created strangely shaped folds of nebulosity. The Pencil Nebula is the brightest part of this huge shell.

This new image shows large, wispy filamentary structures, smaller bright knots of gas and patches of diffuse gas. The nebula's luminous appearance comes from dense gas regions that have been struck by the supernova shock wave. As the shock wave travels through space, it rams into the interstellar material. At first, the gas was heated to millions of degrees, but it then subsequently cooled down and is still giving off the faint glow that was captured in the new image.

By looking at the different colours of the nebula, astronomers have been able to map the temperature of the gas. Some regions are still so hot that the emission is dominated by ionised oxygen atoms, which glow blue in the picture. Other cooler regions are seen glowing red, due to emission from hydrogen.

The Pencil Nebula measures about 0.75 light-years across and is moving through the interstellar medium at about 650 000 kilometres per hour. Remarkably, even at its distance of approximately 800 light-years from Earth, this means that it will noticeably change its position relative to the background stars within a human lifetime. Even after 11 000 years the supernova explosion is still changing the face of the night sky.

[1] The Pencil Nebula, also known as NGC 2736 and sometimes nicknamed Herschel's Ray, was discovered by British astronomer John Herschel back in 1835 while he was in South Africa. He described it as "an extraordinary long narrow ray of excessively feeble light."

[2] A supernova is a violent stellar explosion, resulting from the death of either a high-mass star or a white dwarf in a close double star system. The structure resulting from the explosion is called the supernova remnant. This consists of ejected material expanding at supersonic velocities into the surrounding interstellar medium. Supernovae are the main source of the heavier chemical elements in the interstellar medium, which in turn leads to the chemical enrichment of a new generation of stars and planets.

Mars rover Curiosity wrapping up health checkups

LOS ANGELES (AP) ? The Mars rover Curiosity is preparing to roll again after it completes its health checkups this week, project managers said Wednesday.

Since landing in an ancient crater near the Martian equator Aug. 5, the car-size rover has trekked more than the length of a football field, leaving wheel tracks in the soil that could be spied from space.

The most high-tech rover sent to the red planet, it spent the past month testing its instruments before embarking on a mission to examine whether the environment could have been hospitable to microbial life.

Mission manager Jennifer Trosper said the six-wheel Curiosity has "performed almost flawlessly" so far.

It still has to do a final check of its robotic arm and aim its camera to track one of Mars' moons, Phobos, passing in front of the sun before hitting the road Friday night.

"The plan is to drive, drive, drive," said Trosper of the NASA Jet Propulsion Laboratory, which manages the $2.5 billion mission.

Curiosity is headed toward a spot called Glenelg where three types of terrain meet. Along the way, it will select rocks to study up close and scoop up soil. So far, the rover has used its laser to zap at rocks several feet away. Within a month or so, it plans to use its robotic arm to drill into rocks.

The rover's ultimate destination is Mount Sharp, a mountain rising from the crater floor, but it was not expected to journey there until the end of the year. From orbit, the base appeared to contain signs of past water, providing a starting point to search for the chemical building blocks of life.

Second-hand smoking damages memory

ScienceDaily (Sep. 11, 2012) ? Non-smokers who live with or spend time with smokers are damaging their memory, according to new research from Northumbria University.

The findings, published in the latest online edition of the journal Addiction is the first study to explore the relationship between exposure to other people's smoke and everyday memory problems.

Dr Tom Heffernan and Dr Terence O'Neil, both researchers at the Collaboration for Drug and Alcohol Research Group at Northumbria University, compared a group of current smokers with two groups of non-smokers -- those who were regularly exposed to second-hand smoke and those who were not.

Those exposed to second-hand smoke either lived with smokers or spent time with smokers, for example in a designated "smoking area," and reported being exposed to second-hand smoke for an average of 25 hours a week for an average of four and a half years.

The three groups were tested on time-based memory (remembering to carry out an activity after some time) and event-based memory (which refers to memory for future intentions and activities).

Researchers found that the non-smokers who had been exposed to second-hand smoke forgot almost 20% more in the memory tests than those non-smokers not exposed. However, both groups out-performed the current smokers who forgot 30% more than those who were not exposed to second-hand smoking.

Dr Heffernan said: "According to recent reports by the World Health Organization, exposure to second-hand smoke can have serious consequences on the health of people who have never smoked themselves, but who are exposed to other people's tobacco smoke.

"Our findings suggest that the deficits associated with second-hand smoke exposure extend to everyday cognitive function. We hope our work will stimulate further research in the field in order to gain a better understanding of the links between exposure to second-hand smoke, health problems and everyday cognitive function."

KARACHI, Pakistan (AP) ? The death toll from a pair of devastating factory fires that broke out in Pakistan's two biggest cities rose on Wednesday to 314 people, many of whom perished because they were unable to escape buildings that lacked emergency exits and basic safety equipment such as alarms and sprinklers.

The horrific toll highlights the atrocious state of industrial safety in Pakistan, where many factories are set up illegally in the country's densely populated cities, and owners often pay officials bribes to ignore safety violations.

The more deadly of the two blazes, which both erupted on Tuesday night, was at a garment factory in the southern city of Karachi, the country's economic heart.

The death toll there rose to 289 people Wednesday, as firefighters battled the flames for hours, said senior government official Roshan Ali Sheikh. It was one of the worst industrial accidents in Pakistan's 65-year history, and Sheikh said the death toll could rise because rescue workers were still pulling bodies out from the site in Karachi.

Most of the deaths were caused by suffocation as people caught in the basement were unable to escape when it filled with smoke, said the top firefighter in Karachi, Ehtisham-ud-Din.

The building only had one accessible exit, and all the other doors were locked, said Sheikh.

"It is a criminal act to lock the emergency exit doors, and we are trying to know who did it, and why?" Sheikh said.

Relatives of the victims said the factory owner locked the exit doors in response to a recent theft, thereby endangering the workers inside.

"The owner of the factory should also be burned to death the way our dear ones have died in a miserable condition," said Nizam-ud-Din, whose nephew died in the fire.

Workers on higher floors of the five-story building struggled to make it out of windows that were covered with metal bars. Many were injured when they jumped from the building, including a 27-year-old pregnant woman who was injured in the fall.

Another injured factory worker, Mohammad Ilyas, speaking from the hospital, said he was working with roughly 50 other men and women on one of the floors when suddenly a fireball came from the staircase.

"I jumped from my seat as did others and rushed toward the windows, but iron bars on the windows barred us from escaping. Some of us quickly took tools and machines to break the iron bars," he said. "That was how we managed to jump out of the windows down to the ground floor."

His leg was injured in the fall.

Others weren't so lucky. An Associated Press reporter saw a charred body partially hanging out one of the factory's barred windows. It appeared the victim tried to escape but couldn't make it through the bars.

"There were no safety measures taken in the building design. There was no emergency exit. All the people got trapped," said senior police official Amjad Farooqi.

The factory's managers have fled and are being sought by police, Sheikh said, who is the senior government official in Karachi. He added that authorities have placed the name of the factory's owner on the list of people who are not allowed to leave the country.

Also on Tuesday night, a fire swept through a four-story shoe factory in the eastern city of Lahore, killing 25 people. Some died from burns and others from suffocation, said senior police officer Multan Khan.

The factory was illegally set up in a residential part of the city. The fire broke out when people in the building were trying to start their generator after the electricity went out. Sparks from the generator made contact with chemicals used to make the shoes, igniting the blaze.

Pakistan faces widespread blackouts, and many people use generators to provide electricity for their houses or to run businesses.

One of the workers, Muhammad Shabbir, said he had been working at the factory for six months along with his cousin. He said all the chemicals and the generator were located in the garage, which was also the only way out of the building. When the fire ignited, there was no way to escape.

Shabbir said he had just gone outside the factory when the fire started, but his cousin was inside and was severely burned. He died at the hospital.

A firefighter at the scene, Numan Noor, said the reason most of the victims died was because the main escape route was blocked.

"The people went to the back side of the building but there was no access, so we had to make forceful entries and ... rescue the people," Noor said.

Firefighters broke holes in the factory's brick walls to reach victims inside. At the morgue, bodies were lined up on a hallway floor, covered with white sheets.

Pakistani Prime Minister Raja Pervaiz Ashraf expressed his shock and grief over the deaths in the two cities.

Deutsche Bank to detail job cuts, strategy

FRANKFURT (Reuters) - Deutsche Bank's new leadership will present plans for building capital and cutting costs on September 11 in an attempt to address analyst doubts over the lender's ability to generate profits in weak financial markets.

After 100 days in office, new co-chief executives Anshu Jain and Juergen Fitschen will present details about where they will focus job cuts, as banks adapt to an industry-wide downturn in investment banking profits.

Deutsche will provide details about a restructuring of asset management, after failing to find a buyer for the division.

Analysts are looking for reasons to re-invest after the bank last year abandoned its target of generating a pretax return on equity (RoE) of 25 percent, and delivered a paltry 6.8 percent pretax RoE in the second quarter.

With increased regulation and lower levels of risk taking, the lender faces a cyclical and structural dip in profit levels, so the strategy update will largely amount to explaining how to shrink the business, analysts said.

"The devil is in the details on the September 11 investor day," J.P. Morgan analysts said, keeping a neutral rating on the stock.

One issue is how well capitalized and how profitable Deutsche Bank needs to be to remain competitive.

J.P. Morgan said Deutsche needs to plug a capital shortfall of $6.2 billion to meet Basel III capital rules by 2013. Because Deutsche has said it will avoid resorting to a capital increase through issuing new shares, the bank will instead shed risky assets.

Fewer toxic assets means having to set aside less capital under Basel banking rules, but potentially also fewer jobs and less profit.

Deutsche has already announced 3 billion euros ($3.84 billion) worth of cost cuts, including shedding 1,900 jobs.

Most of these - 1,500 - will fall upon the investment bank, which eats up around 70 percent of the group's capital.

A raft of failed initial public offerings and a dip in merger and acquisitions activity will force Deutsche to look hard at which businesses it wants to keep, particularly in equities.

New rules which force banks to apply stricter ways to measure risky assets have already inflated Deutsche's balance sheet from 2.164 trillion euros at the end of December, to 2.241 trillion at the end of July.

Deutsche has already detailed some additional risk-weighted asset reduction measures.

But to meet Basel III rules through shrinkage, Deutsche needs to slash another 43 billion euros worth of risky assets from its balance sheet, analysts at Espirito Santo Investment Bank research said.

Cutting assets has already hurt Deutsche's market share in key areas, Espirito Santo said.

"From first half 2011 until first half 2012, Deutsche Bank lost the greatest revenue share in the fixed income currencies and commodities space compared with global peers."

In addition to fewer bankers, Deutsche has said it will review its compensation policy to address both the absolute level of compensation and the relative balance between rewards for shareholders and staff.

Deutsche Bank has been less aggressive than peers Credit Suisse and UBS in cutting deferred bonuses. To free up capital, Deutsche could cut deferred bonuses by 600 million euros, analysts said.
